1. Acceptance of Terms
By downloading, installing, or using the RallyMap mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use after notification constitutes acceptance of the updated Terms.
2. User Accounts
To use most features of RallyMap, you must create an account. By creating an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your password
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use at support@rally-map.com
You must be at least 13 years of age to create an account. By creating an account, you represent that you are at least 13 years old.
We reserve the right to terminate accounts, refuse service, or remove content at our sole discretion, with or without notice.
3. Content Guidelines
RallyMap is a community platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content within the App and in connection with our services.
You are solely responsible for all content you post. Content must not:
- Be unlawful, harmful, threatening, abusive, harassing, or defamatory
- Infringe upon intellectual property rights of others
- Contain explicit sexual content or graphic violence
- Promote discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age
- Contain spam, chain letters, or unsolicited advertising
- Impersonate any person or entity
- Encourage illegal activity or reckless driving
- Contain malware, viruses, or harmful code
We reserve the right (but not the obligation) to remove content that violates these guidelines without notice.
4. Rally Participation Rules
RallyMap provides tools for organizing and participating in car rallies. By using rally features, you acknowledge and agree to the following:
- Legal Compliance: All rallies must comply with local traffic laws. You are solely responsible for operating your vehicle safely and legally at all times.
- No Racing: RallyMap does not condone street racing, speed contests, or any activity that endangers yourself or others. Rallies using our platform must not involve competitive speeding.
- Personal Responsibility: You accept full responsibility for your participation in any rally, including all risks associated with driving.
- Permission: Rally routes must only use public roads or private property with explicit permission from property owners.
- Accuracy: Rally creators are responsible for ensuring route information, hazard alerts, and other rally details are accurate.
- Alcohol and Substances: Never drive under the influence of alcohol or drugs. RallyMap will immediately terminate accounts found organizing or promoting events involving impaired driving.
RallyMap is not responsible for accidents, injuries, property damage, traffic violations, or any other consequences arising from rally participation.
5. Subscription Terms
RallyMap offers both free and premium subscription tiers. Premium features are available through paid subscriptions.
5.1 Billing
Subscriptions are billed through the Apple App Store. You authorize Apple to charge the applicable subscription fee to your payment method on file. Prices are subject to change with notice.
5.2 Renewal
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage subscriptions and turn off auto-renewal in your Apple ID account settings.
5.3 Refunds
Refund requests are handled by Apple in accordance with their refund policies. We do not process direct refunds for App Store purchases. To request a refund, contact Apple Support.
5.4 Free Trial
If a free trial is offered, it converts to a paid subscription at the end of the trial period unless cancelled. Cancellation must occur before the trial ends to avoid charges.
6. Prohibited Conduct
You agree not to engage in any of the following:
- Using the App for any unlawful purpose
- Attempting to gain unauthorized access to other accounts or App systems
- Scraping, crawling, or extracting data from the App
- Reverse engineering or attempting to extract source code
- Using automated means to access or use the App (bots, scripts)
- Interfering with or disrupting the App or servers
- Creating fake accounts or providing false information
- Harassing, stalking, or threatening other users
- Using the App to distribute spam or malware
- Attempting to circumvent subscription payments or access premium features without payment
- Violating the privacy of other users by sharing their location data without consent
7. Intellectual Property
The App, including its design, code, graphics, and content created by RallyMap, is owned by RallyMap and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary content.
“RallyMap” and related marks are trademarks of RallyMap. You may not use our trademarks without prior written permission.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
9. Disclaimer of Warranties
The App is provided “as is” and “as available” without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
RallyMap does not warrant the accuracy of hazard reports, route information, or other user-generated content. Always exercise independent judgment when driving.
10. Limitation of Liability
To the maximum extent permitted by applicable law, RallyMap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the App.
In no event shall our total liability to you for all claims exceed the amount you paid to RallyMap in the twelve months preceding the claim, or $100 USD, whichever is greater.
RallyMap is not liable for any vehicle accidents, traffic violations, personal injuries, property damage, or any other harm arising from rally participation or use of the App's navigation or tracking features.
11. Indemnification
You agree to indemnify, defend, and hold harmless RallyMap and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the App.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
